Release, Permissions and Terms

If you have provided GEOKON, INC with a project summary to be featured on our Recent Projects page, added to our collection of various Projects, and/or promoted on social media, please read and agree to the following:

I hereby grant and authorize GEOKON, INC the right to:

• Take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures and written copy provided by me to be used in and/or for legally promotional materials (existing or later created or made available) including, but not limited to, newsletters, flyers, posters, brochures, advertisements, press kits and submissions to journalists, websites, social media, social networking sites and other print and digital communications, without payment or any other consideration.
• This authorization extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorization in writing.

I understand and agree that:

Any and all materials, including pictures and written copy, provided by me shall become the property of GEOKON, INC and will not be returned.

I hereby hold harmless, and release GEOKON, INC from all liability, petitions, and causes of action which I, my heirs, representative, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.

Visitor Agreement for Training Courses and Related Activities

By selecting the “Consent to Photography” check box, and submitting any related form(s), present on the GEOKON, INC website, I confirm that I have read, understand the conditions of, and consent to my likeness being used as described below.

This Consent to Photography, Video Recording, and Audio Capture (“Agreement”) is entered into by any Training Course Attendee (“Visitor”) and GEOKON, INC (“Company”). This Agreement governs the capture and use of visual and audio media in connection with the Company’s training courses, geotechnical instrumentation, monitoring, testing, and related activities (“Operations”).

By entering any area owned, leased, or controlled by the Company (“Premises”), or by participating in any Company‑sponsored training course, site visit, demonstration, or related activity, the Visitor acknowledges and agrees to the terms set forth below:

1. Purpose

   The purpose of this Agreement is to obtain the Visitor’s consent for the Company to capture, use, and retain photographs, video recordings, audio recordings, and other media (“Media”) created during the course of Operations, and to define the rights and limitations associated with such Media.

2. Consent to Recording and Media Capture

   The Visitor hereby grants the Company the irrevocable right to photograph, film, record, or otherwise capture the Visitor’s image, likeness, voice, and presence in connection with:

   • Training courses and product demonstrations
   • Geotechnical instrumentation installation, calibration, monitoring, testing, and safety briefings
   • Field operations, site inspections, and data‑collection procedures
   • Corporate communications, educational materials, and internal documentation

   This consent applies to both intentional and incidental capture of the Visitor during the normal course of Operations.

3. Ownership and Authorized Use

   The Visitor acknowledges and agrees that:

   • All Media captured by the Company is the exclusive property of the Company
   • The Company may use, reproduce, publish, display, distribute, archive, or otherwise utilize the Media for any lawful business purpose, including but not limited to:
     • Training, instructional, and safety‑related materials
     • Technical documentation, reporting, and project records
     • Marketing, promotional, and public‑facing communications
     • Website, social media, and digital content
     • Internal quality assurance, operational review, and compliance documentation
   • Such use may occur without further notice, approval, or compensation to the Visitor
   • The Visitor waives any right to inspect, approve, or restrict the Company’s use of the Media

4. Optional Opt‑Out for Public‑Facing Media

   If the Visitor prefers not to appear in Media intended for marketing, promotional, or other public‑distribution purposes:

   • The Visitor must notify a Company representative prior to entering the Premises or participating in Operations
   • The Company will make reasonable efforts to avoid intentional capture of the Visitor in non‑essential contexts.

   The Visitor acknowledges that due to the nature of geotechnical and construction‑related training and/or work—including classrooms, active job sites, safety monitoring zones, and continuous documentation requirements—complete exclusion from all recording cannot be guaranteed.

5. Operational, Safety, and Compliance Recording

   The Visitor understands and agrees that the Company may utilize fixed cameras, time‑lapse systems, instrumentation‑mounted cameras, UAV/drone platforms, and other recording technologies for purposes including:

   • Instrumentation performance verification
   • Site and construction progress documentation
   • Regulatory, contractual, or client reporting
   • Security and loss‑prevention
   • Safety compliance and incident documentation

   These recordings are integral to the Company’s Operations and are not subject to opt‑out.

6. Release and Waiver

   To the fullest extent permitted by law, the Visitor hereby releases, discharges, and holds harmless the Company and its officers, employees, subcontractors, agents, and representatives from any claims, demands, liabilities, or causes of action—which the Visitor, the Visitor’s heirs, representative, executors, administrators, or any other persons may make while acting on the Visitor’s behalf or on behalf of the Visitor’s estate—arising out of or related to:

   • The capture of Media
   • The use, publication, distribution, or storage of Media
   • The Visitor’s presence on the Premises or participation in Operations

   This release applies to all forms of Media captured in accordance with this Agreement.

7. Visitor Acknowledgment

   By entering the Premises or participating in Operations, the Visitor affirms that:

   • They have read and understood this Agreement
   • They voluntarily consent to the capture and use of Media as described
   • They understand that refusal to consent may limit or prevent participation in certain activities where recording is unavoidable for safety or operational reasons

GEOKON, INC maintains an ongoing policy of reviewing and updating the Photo Use and Consent to Photography, Video Recording, and Audio Capture agreements to ensure compliance with applicable laws, internal standards, and operational requirements. We reserve the right to modify, amend, or replace any portion of these agreements at any time and without prior notice.

Continued access to or use of our website, services, or facilities following any such changes constitutes acceptance of the revised terms. Visitors are encouraged to review the consent agreements periodically to stay informed of any updates.
